Terms of Service
Last updated: August 16, 2026
Agreement
By using rescue404.com, submitting an intake request, or purchasing a diagnostic, repair, Care plan, or related service from Rescue 404, you agree to these Terms. If you do not agree, do not use the site or services.
A written quote, invoice, or Care agreement may add project-specific terms. Where those conflict with this page on price or scope for a paid engagement, the written quote or agreement controls for that engagement.
Services are best-effort
Website repair and Care work depend on hosting access, third-party platforms, DNS providers, plugins, themes, and your cooperation. We diagnose and aim to stabilize and repair within the agreed scope where access and the environment allow. We do not guarantee that every site can be fixed, that downtime will be avoided, that malware will never return, or that performance, sales, or search rankings will improve.
Closed builders (for example Wix, Squarespace, Webflow) and restricted shared hosting may limit or prevent repair. We will say so when we know.
Client responsibilities
You are responsible for maintaining current backups where possible before and during work, for providing accurate information, for securing and rotating credentials, and for decisions about going live. Unless a Care plan or written agreement says otherwise, you own backup verification and retention on your host.
Share passwords only through self-destructing link tools after we reply — never in the public intake form, chat, or ordinary email body.
Diagnostics, quotes, and repairs
Rescue work typically starts with a paid Rescue Diagnostic. The diagnostic fee is credited toward the repair if you proceed with us under the quote we provide. The diagnostic itself is payment for investigation and a written fix quote — it is not refundable if you decline to proceed.
Repair packages and project work proceed only after you approve a written scope and price. “From” price bands on marketing pages are typical ranges after investigation, not capped all-in guarantees for every site.
Care plans and response targets
Care plans have published includes, excludes, minute allowances, and severity response targets. Response targets are acknowledgement / response goals during Eastern Time business hours — not fix-time guarantees and not a 24/7 human dispatch promise. Automated monitoring may run continuously; human work follows plan terms.
Eligible WordPress and WooCommerce Care Plans normally run in our managed hosting environment. Managed hosting is included with no separate standard hosting charge for typical small-business sites. External hosting is not a standard Care offering; unusual situations may be reviewed individually before enrollment and are not guaranteed to be accepted. Normal Care coverage starts after onboarding / migration verification. Host panels we do not control (including reviewed exceptions and hosted SaaS platforms) limit what we can deliver; we work within the access and environment available.
Website use and guides
Troubleshooting guides and educational content on this site are for general information. Following DIY steps is at your own risk. Guides are not a substitute for a paid engagement and carry no warranty.
Payment
Fees are due as stated on the invoice or checkout instructions. Care billing, minimum terms, cancel notice, and related commercial gates are described on Care plan materials and confirmed in writing before enrollment. Refund and chargeback rules are in the Refunds & Payment Policy on this site.
Limitation of liability
To the fullest extent permitted by law, Rescue 404 is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for losses arising from hosting providers, DNS registrars, plugin/theme vendors, CDNs, malware re-infection after handoff, or your failure to maintain backups.
Our total liability for a paid engagement is limited to the fees you paid us for that specific engagement. These limits are drafts pending attorney review for your jurisdiction.
Governing law
These Terms are intended to be governed by the laws of the State of New York, United States, without regard to conflict-of-law rules — subject to change after attorney review and any mandatory consumer protections that apply to you.
